STATE REGULATORY INFORMATION

The 1969 Wyoming Legislature enacted Chapter 111, Session Laws 1969, which is the Wyoming Education Code of 1969, Chapter 11 of the new code in effect amended the previous Private School Licensing Act, which empowered the State Board of Education to license, through the State Department of Education, "all trade, correspondence, technical, vocational, business, or other such private schools" soliciting students in Wyoming, requiring that such schools be licensed, and providing for the establishment of minimum standards.

State Board of Education may license and set minimum standards. (a) The State Board of Education may license through the state department of education all trade, correspondence, technical, vocational, business, or other private schools as defined by W.S. 21-101(a)(iii) within the state of Wyoming. (b) The board shall establish minimum standards for all schools described in subsection (a) of this section and provide for such investigation and evaluation of the schools it deems necessary.

Annual License Fee. Those schools in addition to similar schools outside the state of Wyoming which employ an agent for the purpose of soliciting resident students shall pay an annual license fee to the State Board of Education in an amount not to exceed two hundred dollars ($200) which shall be paid into the general fund.

Licensing and Regulation of Qualifications of Agents of Private Schools. The state board may license the agents of those schools who operate in the state of Wyoming and may regulate the qualifications of their agents. In addition, the state board may establish a license fee not to exceed one hundred dollars ($100). The license fees shall be deposited in the general fund. Operation Without License Unlawful; Soliciting Business in Public Schools; Furnishing List of Students. (a)No person shall operate a school as defined in W.S. 21-2-401 in Wyoming and no private school shall conduct business in Wyoming without first obtaining a license under this article. (b)Unless the school, proprietor or its agent has been licensed as required under this article, no official or employee of the Wyoming Department of Education, any college or university within the state or any school district within the state shall:

  1. Permit the school or proprietor or agent thereof to solicit business in any public school within this state; and
  2. Provide any list of students or other list of prospects to the school or proprietor or agent thereof.

Performance Bond. Before any school is issued a license under this article, it shall submit to the state department of education a ten-thousand ($10,000)dollar, twenty-five thousand ($25,000) dollar, or fifty thousand ($50,000) dollar (based upon the number of students) performance bond to be approved by the attorney general. The bonds shall be renewed on a yearly basis thereafter as long as the school retains its license to do business in Wyoming. The performance bond is to assure protection of all persons enrolled in a course of study who may be aggrieved by any school doing business, or operating in, the state of Wyoming. The department of education will be custodian of all bonds filed and may render administrative, but not legal, assistance to all aggrieved persons who may be entitled to relief under the bond.

Schools Exempted. This article does not apply to any parochial, church, or religious school as defined by W.S. 21-4-101(a)(iv), home-based educational programs as defined by W.S. 21-4-101(a)(v), aircraft flight training schools approved and authorized by the federal aviation agency of the United States of America, or a school teaching techniques of outdoor recreation, leadership, ecology, or conservation domiciled in the state of Wyoming.

Penalties; Injunction. Any person violating the provisions of this article is guilty of misdemeanor punishable by a fine of not more than one hundred dollars ($100), by imprisonment in the county jail not to exceed six (6) months, or both. Each solicitation of enrollment or each transaction of business without a license constitutes a separate offense. Any person violating the provisions of this article may also be enjoined from the continuation of the violations by proceedings brought by the attorney general, any district attorney, any school official or any aggrieved citizen, regardless of whether criminal proceedings have been in Wyoming.
