STATE REGULATORY INFORMATION

The following guidelines are established for the basis of approval and issuance of certificates to operate private business and vocational schools. They are established pursuant to Illinois Compiled Statutes 105 ILCS 425, Chapter 144.

Compliance Requirements: A school is defined as an educational institution privately owned, offering programs for which tuition is charged by in-residence, correspondence or other means to prepare individuals to follow a trade, to pursue certain vocational or professional occupations, or enhance certain such skills and abilities. Not included are nonprofit schools conducted by eleemosynary, religious, or public institutions exempt from property taxation and programs offered by employers to employees only. A school requires Illinois approval when it maintains an office, mails instructional materials, grades lessons, holds classes, solicits enrollment by solicitors or advertisement originating in Illinois, or any combination of these within the state.

The Educational Task of the Institution: A statement of purpose that provides a guide to judge the educational planning of the school must be submitted.

Operational Financial Resources: The financial structure of each institution shall provide adequate financial resources available to meet its operating demands for at least one calendar year. An institutional surety bond is required.

Plant and Equipment Resources: The physical plant, including buildings, grounds, and equipment must be adequate to meet the requirements of the educational program.

Administrators: The minimum qualification for supervisors shall be a four-year degree from a recognized college or university with satisfactory completion of 24 semester hours in administration management, professional education, or in one or more of the subject areas in which the school provides instruction or a combination of 3 years of training and on-thejob experience in one or more of the subject areas in which the school provides instruction and at least one year of administrative/management experience.

Instructors: Each teacher shall possess at least one of the following qualifications:

  1. Graduation from a state-approved, fouryear degree granting school with satisfactory completion of 24 semester hours in the academic or vocational/skill subject area in which the applicant will teach with at least one three-semester hour course in each subject.
  2. A combination of no less than 2 years of successful training and on-the-job experience in the academic or vocational/skill subject area in which the applicant is to be assigned.
  3. Completion of no less than 6,000 clock hours of successful on-the-job experience in the academic or vocational/skill subject area in which the applicant will be assigned to teach.

Admission Standards: Basic requirements for entrance to a school are graduation from a four-year high school, satisfactory completion of a GED examination, or appropriate background to indicate a reasonable chance of success.

Sales Representative: Every sales representative of an approved business or vocational school shall comply with the requirements of the Private Business and Vocational Schools Act, including bonding.

Cancellations and Refunds: The Illinois cancellation and refund policies are designed to protect the interest of the student and at the same time recognize the obligations which a student undertakes when contracting with a private business or vocational school for educational training.

Ethical Practices and Advertising: A school must disclose to prospective students, prior to enrollment, all material facts, including date of completion and placement, concerning the school and the course which are likely to affect that student's decision to enroll or not to enroll.

Contracts: All contracts shall be separate and distinct from any other documents and must be clearly labeled as an enrollment agreement. The enrollment agreement of all schools must clearly disclose the refund policy and a copy of the contract must be furnished to all students. Payment of tuition through an installment or deferred payment plan must comply with the provisions of both the Retail Installment Contract Act of Illinois and the United States Truth in Lending Act.
