STATE REGULATORY INFORMATION

The State Legislature of Ohio passed primary legislation governing proprietary schools effective as of December 1, 1970. This has been amended as recently as June 30, 1997. Through the enactment of this legislation a State Board of Proprietary School Registration is responsible for the regulation and supervision of most home study, business, trade and technical and other proprietary schools soliciting students in Ohio.

Such schools are required to secure a Certificate of Registration from the State Board of Proprietary School Registration. This Board shall issue a Certificate of Registration to an applicant of good reputation offering one or more courses after determining the faculty and physical facilities are available to provide students with the kind of instruction purported to offer. A Certificate of Registration shall be granted within 120 days. Registration numbers are assigned to all registered schools and such registration number shall be used in all advertisements and publications bearing the name of the school. The Certificate of Registration is valid for two years unless earlier revoked for cause by the Board.

No courses of instruction shall be established offered, or given; no diploma, degree, or written evidence shall be offered or awarded; and no student enrollment shall be solicited through advertisement, mail, circulars, or other means until the person planning to offer such a course of instruction has obtained a Certificate of Registration from the Board.

Application shall be accompanied by a surety bond in the penal sum of $10,000. The bond shall provide for the indemnification of any person suffering loss as a result of fraud or misrepresentation on the part of a school to secure a student's enrollment.

No person may act as an agent for any school unless be first secures a permit as an agent from the State Board of Proprietary School Registration and is an employee of the school. If the agent represents more than one school, a separate permit is required for each school represented by him. An agent who represents a person that operates more than one school in the same geographical area as determined by the Board need not obtain a separate permit. Upon approval for a permit, the Board issues a pocket card identifying the agent and school represented. To secure the permit, a surety bond in the penal sum of one thousand dollars must accompany the application. Such bond provides for the indemnification to any student suffering loss as a result of fraud or misrepresentation.

The agent's permit is valid for one year from the date of issue, unless revoked by the Board for cause. The issuance of a permit does not constitute approval of any course of instruction or the persons, or institutions. Student Tuition Recovery Fund was established to protect students from tuition loss whether due to business failure or any other reason for which the student is not legally responsible. Payment is due annually by July 31, and is calculated by prior year's tuition receipts.

Any person adversely affected by actions of a Certificate holder may file a complaint with the State Board of Proprietary School Registration. All schools must include in the enrollment agreement notice that students may direct any problems or complaints to the State Board. Schools must conduct a survey to determine student satisfaction. Surveys shall be administered prior to the end of each school year.
