Istiḥsān

Istiḥsān (Arab.). A method of legal reasoning used in conjunction with qiyās (analogy), especially by the Ḥanafite law school. Istiḥsān can best be understood as juristic preference for a principle of law to promote the aims of the law. It is closely related to istiṣlāh.
