TALK BACK Affirmative action vs. equal protection; DEAR MR. MCCANLES: Your citing Justice Lewis Powell's pivotal opinion in the Allan Bakke case is curious in that the opinion backed affirmative action or, if you will, racial preferences to promote "educational diversity." What Powell disapproved on behalf of a convoluted court majority was rigid quotas. According to a Powell biography written by one of his former law clerks, the justice thought that ending affirmative action would be "a disaster for the country." Our position on affirmative action corresponds with the standards enunciated in the Bakke ruling standards being rolled back today, portending the disaster that Powell feared.
