assize
assize, a form of civil legal remedy available in the courts of the medieval lordship whose distinctive characteristic was that of allowing a jury to give a verdict on the merits of a claim in the defendant's absence from court. The two main types of assize were novel disseisin, where the claimant asserted he had been unjustly dispossessed of land, and mort d'ancestor, where he asserted that a close relative had died in possession of land and he was the rightful heir. A less common form (darrein presentment) allowed a patron to assert his right to present a rector to a church at a vacancy. All three types of assize had been created by Henry II and his advisers for use by litigants in England between 1166 and 1179. Novel disseisin and mort d'ancestor were in use in Ireland before the end of the 12th century, darrein presentment a little later. ‘Assize’ also refers to the jury giving the verdict in such cases; assizes came to mean the regular county sessions of royal justices held from the last quarter of the 13th century onwards to hear assizes and try prisoners in custody in local gaols.
