Peter Walsh of Action against Medical Accidents discusses the implications of legal aid and NHS reforms for clinical negligence claimants

ABSTRACT

Perceptions of a 'compensation culture' are discussed in the context of the actual incidence of clinical negligence claims and cost to the state. Impending reforms of the way that legal aid is made available to seek compensation for clinical negligence through the courts and the Government's proposals for reform of the way the NHS deals with clinical negligence are discussed, and suggestions are put forward for improvement of the proposals.
