Hilbert sues, dangles deal

Stephen Hilbert has filed a lawsuit against Conseco Inc., the company he founded, arguing that legal language in his termination agreement and other documents frees him from having to repay more than $209 million in loans.

At the same time, however, the former CEO is talking settlement, according to his attorney, David Kleiman of Dann Pecar Newman and Kleiman. Kleiman said Hilbert has submitted an offer to Conseco to resolve his loans, but Kleiman declined to disclose terms.

"We expect a ruling from the court that Mr. Hilbert is absolved of liability," Kleiman said ... written statement. ...
