ABSTRACT

This Note is an examination of private counsel participation in the World Trade Organization1 (WTO) dispute settlement process and the relevant considerations involved. This examination is especially pertinent in light of both the increasing amount of litigation before the WTO dispute settlement process and the planned upcoming congressional review of the WTO Agreement. Two major questions arise in this area: (1) the threshold question of whether WTO Member governments can hire private lawyers to represent them in dispute settlement proceedings, and (2) the subsidiary issue of ...
