'Blackmail' and 'extortion' are opinion, protected as rhetorical hyperbole

A unanimous panel of the U.S. Court of Appeals in San Francisco (9th Cir.) affirmed in May a federal District Court's interpretation of the terms "blackmail" and "extortion" as an author's opinion that is protected as rhetorical hyperbole.

The court affirmed the lower court's dismissal of former Honolulu Mayor Frank Fasi's libel claim against the Honolulu StarBulletin and The (Honolulu) Advertiser.
