INTRODUCTION

The concept of bad faith can only be clearly understood if viewed as a continuum. This requires that the claims handler and defense counsel look forward and backward after receiving notice of a lawsuit. The claims handling field is fraught with dangers; if the clai ms professional does not understand the impact of action or inaction during the claims handling process, a bad faith claim may result.
