The Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) significantly changes chapter 11 cases of individuals. After reviewing how chapter 11 works in an individual's case and how it differs from chapter 13, this article discusses provisions of the new law of particular interest to individual chapter 11 debtors. BAPCPA does not alter many of the fundamental provisions of chapter 11 that make it an unattractive alternative to chapter 13 for an individual desiring to retain exempt property, cram down secured debt and pay unsecured ...
