DEFENDANT MUST PROVE ACT WAS UNDER DURESS
|
The Supreme Court decided a defendant must prove that a crime was committed under duress.
The justices rejected the claim that the responsibility falls to the government to prove that duress was not a factor.
"The claim of duress in most instances depends upon conduct that takes place before the criminal act; and, as the person who allegedly coerced the defendant is often unwilling to come forward and testify, the prosecution may be without any practical means of disproving the defendant's allegations," said the court.
