Lawsuit: Restraining order served after arrest

A Canton resident arrested for allegedly violating a restraining order has filed a civil lawsuit against four Canton police officers, claiming that he was falsely arrested and that arresting officers used excessive force.

John R. Amrhein, 43, of 5 Cape Cod Lane, claims Canton police had no right to arrest him Sept. 16, 2004, because the restraining order he was supposed to have violated was never served on him by the police.

"Before they arrest someone they have to have probable cause," said Valeriano Diviacchi, Amrhein's attorney.
