'Sleep inertia' impaired suspect, lawyers contend
|
Sleep inertia clouded Derrick Miller's decision-making when he
was awakened from a nap to waive his Miranda rights, a psychologist
testified Friday.
Since Miller couldn't make an alert decision, his confession to
involvement in the homicide of Kristopher Lohr-meyer should be thrown
out, Miller's lawyer argued in a hearing in Judge Tom Kane's court.
Kane will hear more arguments and decide Aug. 21 whether a jury
will be allowed to see Miller's videotaped confession in the trial...
