Capitol Steel Corp.'s motion to sell inventory in the bankrupt estate was denied without prejudice Tuesday by U.S. Bankruptc y Judge Robert Berry, until a dispute between Boh Brothers Construction Co. of New Orleans and Capitol can be resolved.

A denial without prejudice indicates the debtor may file a second motion.

The company asked the court to approve the sale of about $1.5 million of the inventory to Victor Kingery of Denver.
