SECTION 17 of the Children Act 1989 did not empower a local authority to provide accommodation in circumstances in which it would not otherwise be required to do so either under the subsequent provisions in Pt III of the Act itself, or more generally under the provisions of the Housing Acts.

The Court of Appeal dismissed the claimant's appeal against a decision in judicial review proceedings that the defendant local authority was not obliged under section 17 of the Children Act 1989 to provide appropriate accommodation in which her two disabled children could live with her as a family unit.
