U.S. 12% black; Death Row, 40% // House bill would curb apparent bias

WASHINGTON The percentage of blacks awaiting execution still is much greater than the percentage of blacks in the nation's population, the Justice Department reported Sunday.

The department's Bureau of Justice Statistics said that as of Dec. 31, 1990, 40 percent of prisoners awaiting execution were black. According to the 1990 census, 12.1 percent of the U.S. population is black.

In 1987, the Supreme Court ruled that statistical evidence of discrimination is insufficient to render death penalty statutes unconstitutional.
