EDITORIALS

A U.S. Supreme Court ruling and subsequent revisions of state policies regarding the conduct of judicial candidates has opened up the electoral process. The rule also has allowed the introduction of mudslinging into pristine -- if uninformative -- campaigns.

Prior to 2002, judicial candidates operated under de facto gag orders. The rules not only prevented candidates from talking about specific cases or rulings, it prevented them from talking about theoretical cases or potential rulings, effectively stifling debate in campaigns in which voters typically have little information on ...
