fraud A false representation by means of a statement or conduct, in order to gain a material advantage. A contract obtained by fraud is voidable on the grounds of fraudulent misrepresentation. If a person uses fraud to induce someone to part with money he or she would not otherwise have parted with, this may amount to theft. See also fraudulent conveyance; fraudulent preference; fraudulent trading.
