The US Constitution is neither an unchanging document created in 1787 nor a text that can be interpreted solely to meet contemporary needs. It is a Constitution whose meaning is informed by all constitutional history that has arisen from the 1787 document. In this way it is like the topographical features of the earth itself, whose present character has been determined by historical geologic forces. Constitutional interpreters must be aware of the constitutional law's dependency on the past.<...
