Few government officials have the tremendous power of the prosecutor. Not surprisingly, prosecutors are frequent targets of civil suits, often by criminal defendants who allege that unscrupulous or overzealous prosecutorial conduct violated their rights. For more than two decades, the Supreme Court has struggled to develop a standard that protects prosecutorial discretion, but still allows recovery for egregious prosecutorial behavior during investigations.
