Criminal charges can be a remedy for serious incidents of workplace violence but cannot replace administrative regulations. These cases share common law elements such as the company having a legal duty to the employee to keep the workplace safe but failing to act in disregard of this duty, leading to an assault. These elements show that recklessness or negligence caused a death. Attorneys should never jump to the conclusion that these cases are easy to prove.
