Smith was awarded damages for torture he suffered by prison guards during the 1971 prisoner uprising at Attica. He is the first of 1,281 prisoners to be awarded damages. A $2.8 billion civil liability lawsuit was filed by the prisoners in 1974.
A former Attica inmate recently was awarded $4 million in damages by a federal jury for injuries he suffered after he was tortured during the deadliest prison riot in U.S. history.
