The US Tax Court has begun to use mediation to resolve tax disputes in certain IRS Coordinated Examination Program cases and other tax appeals, utilizing procedures developed by the Chief Counsel. The process is similar to other types of mediation, with the submission of the case to an agreed-upon mediator. Parties should be aware that selection of the mediator and the creation of the mediation agreement are crucial for reaching a favorable resolution of the case.
