A board of appeals' failure to give notice to abutting property owners of a public hearing on a special permit application kept the time to appeal from the board's decision from running until the neighboring property owner had actual notice of the approved structure, the Massachusetts Appeals Court has ruled (Kramer v. Zoning Board of Appeals of Somerville, No. 04-P-293, Nov. 29, 2005).
