Washington, D.C. -- During a visit to New York in January 1969, an aide to Richard Nixon had a news tip for Al Eisele: Warren Burger would be the new president's first choice for the Supreme Court.

Eisele, a Washington correspondent for the St. Paul Pioneer Press-Dispatch, got the story published, but he said the judge from Minnesota didn't believe it: "Burger called me the next morning and said, `What brand of pot have you been smoking?'-"

A few months later, Burger was chief justice.
