The practice of covering workers' compensation claims through captive companies still has its advantages. First, captives are subject to a lower tax rate. They can also loan money to parents without being subject to withholding taxes. Some states are even considering sanctioning 'composite' captives, companies that cover both workers' compensation and employee benefits. One caveat: captives may have to 'front' coverage in states that require policies to be purchased from admitted carriers.
