CASE FACTS: Jolene Batchelder was 32-weeks pregnant, when on March 11, 2001, she was hospitalized at Loma Linda University Medical Center for treatment to prevent premature labor. The treatment consisted of intravenous infusions of magnesium sulfate, which successfully prevented active labor. On March 28, 2001, a nurse mistakenly administered pitocin, a drug used to induce labor. As a result, Jolene went into premature labor and gave birth to her daughter, Makenna. Tim Batchelder, the child's father, was present when the pitocin was administered in error and knew of the error ...
