The cut-off point for the report was February 15, 2004 so it only applies to the EU-15. Moreover, it does not take into account the added impetus that has been injected into counter-terrorism policy since the Madrid train bombings. In some ways, this makes it all the more damning for the Member States as it implies that while they can easily pass legislation in response to a specific terrorist attack, they are not so good at putting that legislation into practice.
