Introduction
Seth Waxman, the former solicitor general under the Clinton administration, pondered why the solicitor general was at the "losing end of every federalism decision in the past nine years" during a speech given at Stanford University (Waxman, 2001, p. 1115). Waxman's concern about the win-loss rate of the solicitor general had less to do with whether the federalism cases were correctly decided; but rather with the question, "In federalism cases, does the Solicitor General matter?"
